1. PRODUCTS AND SERVICES

Please read these terms and conditions carefully before ordering any services from the website or from the apple store.
The terms “THIRD EAR”, “us” or “we” refers to THIRD EAR MEDITATION LTD.
The term “Device” refers to the device which is used to access the services including but not limited to computers, smartphones, tablets and smart devices. The term “you” refers to the user of the services.
When you order (“Order”) any services from the website, or otherwise use or access the Website or other Services, you agree to be bound by these Terms and all applicable laws, rules and regulations. You may also be asked to click “I accept” at the appropriate place prior to your purchase of or other access to the Services. At such time, if you do not click “I accept”, you will not be able to complete such purchase or gain such access. By using the Website or other Services, you indicate that you accept these Terms and that you agree to abide by them. If you do not agree to these Terms, please refrain from using the Website and other Services.

2. BASIS OF SALE

(a) These Terms and the Order set out the whole agreement between you and us for the supply of the Services. In order to participate in certain Services, you may be notified by us that you are required to agree to additional terms and conditions. Unless otherwise provided by the additional terms and conditions applicable to such Services in which you choose to use, those additional terms are hereby incorporated into these Terms.
(b) Please check that the details in these Terms and on the Order are complete and accurate before you use or commit yourself to purchase the Services. If you think that there is a mistake, please make sure that you ask us to confirm any changes in writing, as we only accept responsibility for statements and representations made in writing by a representative of THIRD EAR.

3. CHANGES TO TERMS

We reserve the right to revise and change the pricing terms at any time without notice to reflect changes within the market affecting our company and business. If you do not agree with the changes to THIRD EAR’s pricing terms then you may choose not to renew your Subscription. If your subscription is ongoing, then you will be notified prior to changes.

4. LIABILITY

THIRD EAR or any other party involved in making, producing or delivering the Services or Content is not liable for any accident of any kind, and equally not liable for any consequential or incidental damages.
By downloading and using THIRD EAR, the user agrees to take full responsibility for their decisions and actions, as well as for what happens both during and after using the Products and Services offered by THIRD EAR.

5. CONTENT

“Content” means music, images, text, graphics, software, audio, video, work authored and other materials posted and provided or otherwise made available through the Services. Content includes without limitation User Content.
THIRD EAR does not claim any ownership in any User Content.
THIRD EAR exclusively own all right, title and interest in and to the Services and Content.
THIRD EAR reserves all rights in and to the app. You may not change, copy or create derivative works based on the App; transfer, lease, sublicense, lend or rent the app to any third party; make the the app available to multiple users through any means.

6. TRADEMARKS

All intellectual property, other trademarks, logos, images, product and company names displayed or referred to on or in the Products and Services are the property of their respective owners. Nothing grants you any right to use, alter or remove or copy such material.

7. MEDICAL DISCLAIMER

We are not a health care or medical device provider, nor should our Services or Products be considered as such. The only entities allowed to do so are physicians and other health care providers. While there is evidence from research that meditation, mindfulness, chanting and controlled breathing can improve performances as well as relationship issues, and can assist in the recovery and prevention process for a variety of conditions, THIRD EAR makes no claims or guarantees that the Services and/or Products provide a therapeutic benefit.
Any advice or other materials in the products are intended for general information purposes only and should in no way and for no reason be considered as a substitute for professional medical advice given to you by a licensed professional

8. SUBSCRIPTION PRICING AND TERMS

THIRD EAR offers two auto-renewing subscription options:

£6.99 per month (first 7 days are FREE)
£49.99 per year (first 7 days are FREE)

Purchasing an Auto-Renewable subscription provides the user with access to over 100 meditations, which are otherwise mostly restricted to unsubscribed users. It also enables users to listen to the meditations as much as they want to without having to wait for the cool down time to reset. The audio files can be locally downloaded into the user’s app. Furthermore, you can access the “Ask Leo” feature which enables you to share your experience of meditation on the app, as well as questions to be included and considered in our monthly video.

The app is functional without purchasing an Auto-Renewable subscription. Nevertheless a majority of the sound tracks are locked and available only for pro mode. The wheel which is a personal meditation program is limited also to 7 days only.

The content is regularly updated approximately but not limited to once a month. New meditations, new sound tracks and new “The Wheel” programs are added.

These prices are for United Kingdom’s customers only.

Pricing in other countries may vary and actual charges may be converted to your Local currency depending on the country of residence.

• Subscription automatically renews unless auto-renew is turned off at least 24-hours before the end of the current period

• Account will be charged for renewal within 24-hours prior to the end of the current period, and the cost will be of £6.99 for monthly subscriptions or £49.99 for yearly subscriptions.

Your THIRD EAR subscription will automatically renew at the end of each term and your credit card will be changed through your iTunes account. You can turn off auto-renew at any time from your itunes account settings but refunds will not be provided for any unused portion of the term.

We make no representation or warranties about the accuracy or suitability for any purpose of the advice, other materials and information published as part of the Services and Products.

Before starting a meditation practice, People with existing mental health conditions should consult their health care provider or physician.
